As the SIR constitutionality case hearing begins in the Supreme Court, senior advocate Rakesh Dwivedi, representing the Election Commission of India (ECI), raises two issues regarding the ‘disguised’ citizenship drive and the indicative documents.
“The Petitioners stated that only the Centre can examine this matter, and not the Election Commission (EC). They also raised arguments regarding Articles 324 and 327, which pertain to the power of Parliament to make election laws,” argues Mr. Dwivedi.
“The Constitution does not preclude the EC from exercising its powers to revise electoral rolls. On the contrary, the law allows the EC to deviate,” he argues.
